Terms of Use

The terms that govern your access to and use of DigiGoCare.

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the DigiGoCare clinic management platform, including our mobile application and web platform (together, the "Service"), operated by DigiGoCare / DigiGo Care Pvt. Ltd. ("we", "us", "our").

By creating an account, subscribing to, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility and Accounts

The Service is intended for use by registered clinics, hospitals, healthcare professionals, and their authorised staff. By registering, you confirm that you are at least 18 years old and authorised to enter into these Terms on behalf of your clinic or organisation.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account and those of the staff you invite.
  • You must ensure that every user you grant access to is authorised and configured with appropriate role-based permissions.
  • You must notify us promptly at info@digigocare.com of any unauthorised access or suspected security breach.

3. Description of the Service

DigiGoCare provides software to help clinics manage appointments, patient records, billing, communications, and related operations. We may add, modify, or remove features from time to time to improve the Service. We do not provide medical advice, diagnosis, or treatment, and the Service is a tool to support — not replace — the professional judgement of qualified healthcare providers.

4. Subscriptions and Payment

  • Access to the Service is provided on a subscription basis for the plan and billing period you select.
  • Subscription payments are processed by Razorpay. We do not store full card numbers or banking credentials.
  • Fees are billed in advance and, except where required by law, are non-refundable for any partial billing period.
  • We may revise pricing on renewal; we will give you reasonable notice of any change before it takes effect.
  • If a payment fails or a subscription lapses, we may suspend or restrict access until the outstanding amount is settled.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable healthcare, data protection, or other regulations.
  • Upload or process data you are not authorised to collect, store, or share.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems and networks.
  • Reverse engineer, copy, resell, or create derivative works from the Service except as permitted by law.
  • Introduce malware, or interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to send unsolicited or unlawful communications to patients or third parties.

6. Your Data and Responsibilities

As between you and us, you retain all rights to the clinic and patient data you enter into the Service. You are responsible for the accuracy, legality, and appropriate use of that data, and for obtaining any consents required from patients under applicable law.

You grant us a limited licence to host, process, and transmit your data solely to provide and support the Service, as described in our Privacy Policy. We handle patient information as a processor acting on your instructions.

7. Intellectual Property

The Service, including its software, design, logos, and content (excluding the data you provide), is owned by DigiGoCare and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.

8. Third-Party Services

The Service relies on third-party providers — including Razorpay for payments, AWS for hosting, and Sentry and PostHog for error monitoring and analytics. Your use of the Service may be subject to those providers' terms, and we are not responsible for their acts or omissions.

9. Service Availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes that temporarily limit availability, and we will aim to minimise disruption where practicable.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. You are responsible for how the Service is used in your clinical and administrative workflows.

11. Limitation of Liability

To the maximum extent permitted by law, DigiGoCare will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the subscription fees you paid to us in the twelve months preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold DigiGoCare harmless from any claims, damages, liabilities, and expenses arising out of your use of the Service, your data, or your breach of these Terms or of any applicable law.

13. Suspension and Termination

You may cancel your subscription at any time in accordance with your plan. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the Service in a way that risks harm to patients, other users, or our systems.

On termination, your right to use the Service ends. You may request an export or deletion of your data as described in our Privacy Policy. Deletion of clinic account data permanently removes all associated patient records, appointment history, and billing data and cannot be undone.

14. Governing Law

These Terms are governed by the laws of India. You agree that the courts of Bengaluru, Karnataka will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service.

15. Changes to These Terms

We may update these Terms from time to time. We will notify active users of material changes via the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page reflects the most recent revision.
